Ditto Fitness Inc. and subsidiaries (collectively, "Ditto Fitness", "us", "we" or "our") are pleased to provide you with access to and use of our website and/or mobile application based platform (collectively, the "Ditto Platform").

Terms

By accessing or using the Ditto Platform, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, do not use the Ditto Platform. The materials contained in this website are protected by applicable copyright and trademark law.

Services and requirements

Ditto Fitness offers home workouts through the platform (the "Services").

You may only use the services as an individual user and if you are (1) older than 18 years and (2) physically able to perform body-weight exercise and have consulted a physician if you have any condition or concern.

Health & Safety (No Medical Advice). The Services provide general fitness information only and are not medical advice and not a medical device. You should consult a physician or other qualified healthcare professional before starting any exercise program, especially if you are pregnant, nursing, have any medical condition, take medications, or have a history of heart, joint, or other issues. Do not use the Services if your physician advises against it. If at any time during activity you feel pain, dizziness, faintness, shortness of breath, nausea, chest pain, or other discomfort, stop immediately and seek medical attention. In an emergency, call your local emergency number (e.g., 911 in the U.S.). You use the Services at your own risk.

Disclaimer

The materials and Services on the Ditto Platform are provided on an 'as is' basis. Ditto Fitness makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Ditto Fitness does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials or Services on the Ditto Platform or otherwise relating to such materials or on any sites linked to this site. Ditto Fitness is not a medical care provider and should not be viewed as an authority on matters of health or the effects of exercises on medical conditions.

License and acceptable use

We grant you a limited, revocable, non-exclusive, non-transferable license to use the Ditto Platform for your personal, non-commercial fitness activities. You may not copy, modify, reverse-engineer, resell, scrape, or interfere with the Ditto Platform, nor access it in order to build a competing service.

iOS app license. If you download the app from Apple's App Store, your use of the iOS app is also governed by Apple's Licensed Application End User License Agreement (the "Apple Standard EULA"). If these Terms conflict with the Apple Standard EULA with respect to your use of the iOS app, the Apple Standard EULA controls.

Subscriptions, Trials, and In-App Purchases (iOS)

Certain features of the Services may require a paid subscription. If you purchase through our iOS app, billing is handled by Apple In-App Purchase and subscriptions auto-renew until canceled in your Apple ID settings. Deleting the app does not cancel a subscription.

Plans and experiments. We may offer different plans and promotional structures from time to time (for example: a free first workout, limited free/demo workouts, free trials, introductory or promotional offers, or an ad-supported free tier). What's included in each plan or offer and where a paywall appears may change over time as we run product experiments. Any such changes won't shorten a prepaid or current billing period.

Trials & offers. From time to time we may offer free trials, introductory pricing, or promotional features. Eligibility for such offers may be limited (for example, one per Apple ID or subscription group). Unless canceled at least 24 hours before the end of the trial or promotional period, the subscription will automatically renew at the then-current price.

Cancellation. You can cancel at any time in your Apple ID settings (Settings ▸ [your name] ▸ Subscriptions). Deleting the app does not cancel a subscription. To avoid being charged for the next period, complete cancellation at least 24 hours before the renewal date. After canceling, you retain access until the end of the current paid term. Ditto cannot cancel on your behalf.

Auto-renewal and billing. Subscriptions auto-renew until canceled. Your Apple Account is charged at purchase confirmation and at each renewal. Taxes may be added where applicable. If Apple cannot process a renewal, access may be suspended until billing is resolved.

Refunds. Refunds for iOS purchases are handled exclusively by Apple under its policies. Ditto does not issue refunds for purchases made via the App Store.

Price & changes. Subscription pricing, durations, or available plans may change. If required, Apple will notify you and may require your consent to continue. Otherwise, you may cancel before the change takes effect.

Fraud and misuse. We may refuse or revoke promotions, trials, or access if we detect abuse or fraud. If we terminate your access for breach of these Terms, no refunds are provided for the current billing period (without limiting any rights you may have under Apple's policies or applicable law).

In-App Chat Features

The Ditto Platform may include AI-powered chat ("AI Chat") and human-assisted support chat ("Support Chat") features.

AI Chat. AI Chat responses are auto-generated by artificial intelligence and may be inaccurate, incomplete or out of date. AI Chat is not medical, fitness, nutritional or professional advice — the Disclaimer and Health & Safety sections above apply in full. Always verify AI Chat output independently before acting on it. Do not rely on AI Chat in an emergency; call your local emergency number instead.

Support Chat. Support Chat connects you with Ditto support agents for informational and troubleshooting purposes only. Agents are not licensed medical, fitness or health professionals, and their responses do not constitute professional advice. Response times are not guaranteed.

Chat Conduct. You agree not to send abusive, harassing, threatening or unlawful content through any chat feature. Do not share sensitive personal information (e.g., credit-card numbers, government IDs or passwords) in chat messages. We reserve the right to moderate, filter or remove chat content that violates these Terms.

Chat Data. We store and use chat conversations (messages you send and receive, including timestamps) in accordance with our Privacy Policy. Chat messages may be reviewed by Ditto personnel or service providers for support, safety and quality-improvement purposes.

Limitations

In no event shall Ditto Fitness or its suppliers be liable for any damages (including, without limitation, physical injuries, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials or Services on the Ditto Platform, even if Ditto Fitness or a Ditto Fitness authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. Without limiting the generality of the above, the entire liability of the Ditto Fitness and any of its suppliers under any provision of these terms and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you through the Services or 100 USD if you haven't purchased anything through the Ditto Platform.

Assumption of Risk

You expressly acknowledge and agree that your access, use and/or involvement with the Ditto Platform and Services may involve potentially dangerous and physical activities that may lead to personal and/or bodily injury, death, temporary or permanent disability, loss of services, loss of consortium, or damage to or loss of property or privacy. You hereby acknowledge and willingly accept these risks and agree to unconditionally release and hold Ditto Fitness harmless from and against all claims, suits, damages, losses, causes of action, costs, expenses or liability arising out of or related to your access, use and/or involvement with any Ditto Fitness Services.

Ditto Fitness has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Ditto Fitness of the site. Use of any such linked website is at the user's own risk.

Feedback

We appreciate your feedback and other suggestions about the Ditto Platform. If you submit to us any feedback or suggestions, we may use and fully exploit them in any manner that we deem appropriate, without any restriction or obligation to compensate you. We will treat any feedback or other suggestions as non-confidential and non-proprietary. You should not submit to us any information or ideas that you consider to be confidential or proprietary.

Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including if you breach these Terms. If we terminate for cause, you remain responsible for charges through the end of your current billing period and no refunds are provided by Ditto for iOS purchases (this does not limit any refund rights available from Apple). You may terminate these Terms at any time by ceasing use of the Ditto Platform and Services; cancellation of a paid iOS subscription must be completed in your Apple ID settings as described above.

Data and Recordings

As part of our Services, Ditto Fitness may (but is not obligated to) record and store your workout data, as well as make use of them to improve the Services.

When you do a workout, we collect your workout recordings such as your numeric pose estimation landmarks (skeleton) for the purpose of rep counting and live form feedback, and answers/feedbacks provided during the workout for the purpose of improving future workouts.

Your camera video is private and never leaves your device. You may withdraw video consent at any time by disabling camera access (which will disable workout functionality).

Modifications

Ditto Fitness may revise these terms at any time. Material changes will be posted in-app or emailed at least seven days before they take effect. By using The Platform you are agreeing to be bound by the then current version of these terms of service.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the state of Delaware, United States and you irrevocably submit to the exclusive jurisdiction of the courts in that state or location.
